- Account information, such as the subscriptions you use, account identifier or other information related to your account;
- Your billing information, place of residence and any other information you provide for the provision of payment services, administration and billing processes;

How we store your information
We take all the appropriate technical and organisational security measures to protect your personal information against unauthorized access and unlawful processing, accidental loss, damage or destruction.
We keep your personal information for no more than is necessary for the purposes set out in this privacy notice unless we are required to so for a longer period to comply with legal, tax or regulatory reasons. When we no longer need or are not required to keep your information we will securely delete your information and ensure all recipients of your data also comply with the same.
Where you have given us your consent to use your data and you decide to withdraw that consent, we will delete your personal data. However, when you withdraw your consent to receive marketing communications, we may need to keep a piece of your information, for example, your email address or account identifier in our records to ensure we do not send you any further marketing communications in the future.
We keep your posted comments and any information you post on our chat for 24 hours or less (where it is deleted by us at our sole discretion or if you have violated our terms and conditions of use). It will then be automatically deleted through our automated system.

2. The Data We Collect About You
Personal data, or personal information, means any information about an individual from which that person can be identified. In the Jamaica market, this definition extends to personally identifiable information for individuals who have been deceased for less than thirty (30) years.
Personal data shall not be extended to or include any data where identifiable information has been removed (anonymous data) or an individual's identity is not ascertainable from the data set, whether on its own or combined with other known information.
We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:
- Identity Data includes first name; maiden name; last name; username or similar identifier; date of birth.
- Contact Data includes billing address; delivery address; email address; telephone numbers.
- Financial Data includes payment card details and any other information provided for the provision of payment services, administration and billing processes.
- Transaction Data includes details about payments to and from you and other details of products, services, plans and/or subscriptions you have purchased from us.
- Technical Data includes internet protocol (IP) address; your login data; MSISDN; GUID; browser information and settings; device model; location; country subscription is registered; operating system and platform; other technology on the devices you use to access this application or website.
- Profile Data includes your username and password; subscriptions; interests and preferences; feedback and survey responses.
- Usage Data includes information about how you use our Website or Application, such as the page(s) visited before and after visiting the website; traffic data; communication data; the pages accessed within the website; the services, products or features used the most; the videos that are streamed; the ads that are viewed or clicked.
- Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
- Any Other Volunteered Information shared through comments on articles and webpages on the Application and Website, which you understand and acknowledge as information made public by you.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific application or website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.
We do not intentionally seek to collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.
If you fail to provide personal data
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a plan, subscription, product or service you have with us but we will notify you if this is the case at the time.
3. How Is Your Personal Data Collected?
We use different methods to collect data from and about you including through:
- Direct interactions. You may give us your Identity, Contact and Financial Data by filling out online forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
6. International Transfers
We share your personal data within entities throughout the Digicel Group of Companies.
Whenever we transfer your personal data out of the country of origin, however, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
- We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data.
- Where we use certain service providers, we may use specific contracts that ensure an adequate level of protection through the use of technical and organizational measures.

7. Data Security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. Please be aware that although we endeavour to provide reasonable security for the information we process and maintain, no security system can prevent all potential security breaches. In any event, we will notify you and any applicable regulator of a breach where we are legally required to do so.
8. Account Deletion & Data retention
How long will you use my personal data for?
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.
Where you have decided to withdraw the consent you have given, we will delete your personal data within thirty (30) days, unless we are required to keep it for the reasons explained herein. We may need to keep a piece of your contact information e.g. email address, in our records, so we know that you have withdrawn your consent and therefore ensure we honour your choice.

9. Your Legal Rights
Under certain circumstances, you have rights in relation to your personal data. You have the right to: Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
Time limit to respond
We try to respond to all legitimate requests within sixty (60) days. Occasionally it could take us longer than sixty (60) days if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

i. LAWFUL BASIS
Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).
