TTFA lawyers request Mark Hovell as sole arbitrator for FIFA dispute

Dr Emir Crowne and Matthew Gayle, the lawyers representing the ousted executive of the Trinidad and Tobago Football Association (TTFA) have proposed that Mark Hovell, a solicitor from Manchester, England, be the sole arbitrator in their case against football’s world governing body FIFA.

Hovell is a highly experienced sports lawyer and insolvency practitioner who specialises in regulatory, governance, commercial and financial matters, across all sports, both in the UK and across the world.

Additionally, he sits regularly as an arbitrator at the Court of Arbitration for Sport (CAS) and The FA's regulatory commissions.

FIFA has until April 14 to submit their comments regarding the request - whether they agree to a sole arbitrator deciding matters and Hovell's appointment.

On March 17, FIFA wrote to the TTFA advising them that they were appointing a normalisation committee to take over the running of the heavily indebted association. However, despite protests from the executive because such a move would be in breach of the TTFA constitution, FIFA proceeded to name members of the committee on March 26.

The action prompted the attorneys to file an appeal to set aside FIFA's decision before the CAS on Monday, April 6.

On Wednesday, April 8, CAS acknowledged receipt of the appeal.

The lawyers now have until April 17, 10 days from when the appeal was due to be filed, which was Tuesday, April 7. Should they fail to do so CAS will deem the appeal withdrawn.

 FIFA then has 20 days to respond to the filed brief. They would be expected to do so by early May.

CAS has also invited the TTFA lawyers to consider the possibility of mediation.

“I take this opportunity to draw the Parties’ attention to the possibility of submitting this dispute to CAS mediation, which would not prejudice the Parties’ rights to subsequently re-submit the dispute to arbitration, should the dispute remain unresolved at the conclusion of the mediation procedure, “wrote Antonio De Quesada, Head of Arbitration.

“A successful mediation procedure would result in a binding settlement, the terms of which have been agreed upon by both Parties.”

    Chief Executive Officer (CEO) of the Trinidad and Tobago Pro League has revealed its players are eager to get back out on the pitch but paying close attention to the country’s re-opening guidelines.

    With European football leagues set to resume next month, there is yet to be any indication as to when some of the Caribbean’s local leagues can resume play.

    “Contant sports have not been mentioned in any of the phases listed by the government in terms of when people can return to doing normal things.  We are hoping that at least by phase five we would be able to start getting ourselves ready to commence the league,” Baptiste told T&T’s 7pmNews.

    Baptiste revealed that the football governing body has already began putting things in place for a speedy re-opening if and when the government go-ahead of given.

    “I know the clubs are eager to resume training, because the time you start to prepare for actual matchday might be short.  Everyone wants to get into the thick of things,” she added.

    “Football means a lot to the players as it keeps them fit, as well as disciplined. It also allows them to get rid of their frustrations on the field.”

    Things in the 11-team league ground to a halt, due to concerns surrounding the virus in early March.  There were three more matchdays remaining in the 2019-2020 season.

    Mexico head coach Gerardo Martino says his season in charge of Barcelona was the worst of his career.

    Martino took over at Camp Nou from Tito Vilanova in July 2013 and enjoyed a positive start, winning the Supercopa de Espana on away goals against Atletico Madrid.

    Barca started the LaLiga season with a 7-0 thrashing of Levante before winning his first Clasico 2-1 at home to Real Madrid in October.

    The season ended in disappointment, though, with Atletico pipping Barca to the title after holding them to a 1-1 draw at Camp Nou on the final day of the league season, having lost the Copa del Rey final to Real Madrid a month earlier.

    Martino, who stepped down after the Atletico draw, says it was trying to get the best out of the squad while attempting to embrace their stylistic traditions that made life difficult.

    "From the results side of things, it wasn't a bad year," he said, as quoted by Sport. "We won a trophy and we played in a final, but at Barcelona what matters is how many trophies you win.

    "However, I say it was my worst year because my contribution as coach started and finished with the management of the team.

    "There were concerns that my management had a short life and, for me, the Clasico against Real Madrid that we won 2-1 at home was key.

    "We scored the second goal running into space and if Barcelona ran into space, it was because something did not fit together.

    "But I understand that, if we could add anything to the team, it was not to deny the possibility of running.

    "Speed was going to make Barcelona more complete because when there were lapses in the dominance of the opposition, it was good to go back and move into space. That was carried out the following year, with Luis Enrique."
